These Terms of Service (“Terms”) are a binding legal agreement between you and EZ-CHECKIN governing your use of the EZ-CHECKIN websites and other offerings (collectively, the “EZ-CHECKIN Platform”). When used in these Terms, “EZ-CHECKIN”, “we”, “us” or “our” refers to the EZ-CHECKIN entity with whom you are contracting.

The EZ-CHECKIN platform offers an online place to book vacation rentals (“Accommodation”), this allows users (“Members”) to search and book an Accommodation. Members who search, book, or use services are “Guests”. You must register an account to access and use many features of the EZ-CHECKIN Platform, and you must keep your account information accurate. EZ-CHECKIN is not a real estate broker or an insurer. For more information on the role of EZ-CHECKIN, see Section 16.

We maintain other terms and policies that supplement these Terms such as our Privacy Policy, which describes our collection and use of personal data.

1 Search and reservation in EZ-CHECKIN

1.1 Searching You can search for vacation rentals using criteria such as the type of Host Service, the destination of the trip, the dates of the trip, and the number of guests. You can also use filters to refine your search results. Search results are based on their relevance to your search and other criteria. Relevance considers factors such as price, availability, reviews, customer service and cancellation history, popularity, previous trips and saved listings, host requirements (e.g., minimum or maximum nights), and more.

1.2 Reservation When you book a Listing, you agree to pay all charges for your reservation, including the Listing price, applicable fees such as the EZ-CHECKIN service fee, offline fees, taxes, and any other items identified during payment (together, “Total Price”). When you receive the booking confirmation, a Accommodation contract (sometimes called a booking in these Terms) is formed directly between you and EZ Checkin. The cancellation policy and any other rules, standards, policy or requirements identified in the Listing or during payment are part of your contract with EZ Checkin.

1.3 Accommodation Reservation An Accommodation reservation is a limited license to enter, occupy and use the Accommodation. EZ Checkin has the right to re-enter the Accommodation during your stay, to the extent that: (i) it is reasonably necessary, and (ii) in accordance with applicable law. 

Any failure by you or any other Occupants to comply with any of the terms, conditions, or policies is a breach of this reservation and may result in a forfeiture of your rights to rent the Property, up to and including immediate removal from the Property without refund and with or without the assistance of law enforcement.

If you stay after departure, EZ Checkin has the right to make you leave in a manner consistent with applicable law, including by imposing fines for overstay. You cannot exceed the maximum allowed number of guests.

1.4 Payment We accept Visa and MasterCard cards. Payment terms for Long-Term Rentals (28+ days) are covered in a Long-Term Rental Agreement

2 Cancellations, travel problems, refunds and booking modifications.

2.1 Cancellations, travel problems and refunds In general, if as a Guest you cancel a reservation, the amount refunded is determined by the cancellation policy that applies to that reservation. But, in certain situations, other policies take precedence and determine how much you are reimbursed. If something beyond your control forces you to cancel a booking, you may be eligible for a partial or full refund under our Extenuating Circumstances Policy.

2.2 Booking modifications Guests are responsible for any booking modifications they agree to make through the EZ-CHECKIN Platform or EZ-CHECKIN customer service direct to make on their behalf (“Booking Modifications”), and agree to pay any additional amounts, fees or taxes associated with any booking modifications.

3 Your responsibilities and risk-taking

3.1 Your Responsibilities You are responsible for your own acts and omissions and are also responsible for the acts and omissions of any person you invite to join or provide access to any Accommodation. For example, this means: (i) you are responsible for leaving an Accommodation (and related personal property) in the state it was in when you arrived, and (ii) you must act with integrity, treat others with respect and comply with applicable laws at all times. If you are booking for an additional guest who is a minor, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor.

3.2 Your assumption of risk You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume all risk arising from your access to and use of the EZ-CHECKIN Platform and any Content (as defined in Section 5), including your stay in any Accommodation.

General Terms

4 Reviews After each reservation, Guests will have the opportunity to review the Accommodation. Your review must be accurate and may not contain any discriminatory, offensive, defamatory or other language that violates our Content Policy or Review Policy. EZ-CHECKIN does not verify the accuracy of reviews and may be incorrect or misleading.

5 Content Some parts of the EZ-CHECKIN Platform allow you to provide comments, text, photos, audio, video, information and other content (collectively, “Content”). By providing Content, in any form and by any means, you grant EZ-CHECKIN a non-exclusive, worldwide, royalty-free, irrevocable, perpetual, sublicensable, transferable license to copy, modify, prepare derivative works from, distribute, publish, and otherwise exploit that Content, without limitation. If the Content includes personal information, our Privacy Policy describes how we use that personal information. When EZ-CHECKIN pays for the creation of Content or facilitates its creation, EZ-CHECKIN may own that Content, in which case the supplemental terms or disclosures will tell you. You are solely responsible for all Content you provide and warrant that it is your property or authorized to grant EZ-CHECKIN the rights described in these Terms. You are responsible and liable if any of your content violates or infringes the intellectual property or privacy rights of a third party. Content must comply with our Content Policy and Non-Discrimination Policy, which prohibits, among other things, discriminatory, obscene, harassing, misleading, violent and illegal content. You agree that EZ-CHECKIN may make available automated services or tools to translate Content and that your Content may be translated using such services or tools. EZ-CHECKIN does not guarantee the accuracy or quality of translations and Members are responsible for confirming the accuracy of such translations.

6 Rates EZ-CHECKIN may charge fees (and applicable taxes) to guests for the use of the EZ-CHECKIN platform. You can find more information about when service fees apply and how they are calculated on our Service Fees page. Unless otherwise stated on the EZ-CHECKIN Platform, service fees are non-refundable. EZ-CHECKIN reserves the right to change service rates at any time and will notify Members of any changes to the rates before they become effective. Rate changes will not affect bookings made before the effective date of the rate change. If you do not agree to a rate change, you may terminate this agreement at any time pursuant to Section 8.2.

7 Rules of the EZ-CHECKIN platform.

7.1 Rules You must follow these rules and you must not help or induce others to break or circumvent these rules.

Act with integrity and treat others with respect.

• Don’t lie, misrepresent something or someone, or pretend to be someone else.
• Be courteous and respectful when communicating or interacting with others.
• Follow our Non-Discrimination Policy and do not discriminate against or harass others.

Not to extract content, not to access illegally, not to reverse engineer, not to compromise or undermine the EZ-CHECKIN Platform.

• Do not use bots, crawlers, content extractors or other automated means to access or collect data or other content from or interact with the EZ-CHECKIN Platform in any other way than permitted.
• Do not hack, prevent, delete, impair or attempt to circumvent any security or technological measures used to protect the Platform or the EZ-CHECKIN Content.
• Do not decrypt, decompile, disassemble or reverse engineer the software or hardware used to provide the EZ-CHECKIN Platform.
• Do not take any action that may damage or adversely affect the performance or proper functioning of the EZ-CHECKIN Platform.

Use the EZ-CHECKIN Platform only as authorized by these Terms or other agreements with us.

• You may use the Content available through the EZ-CHECKIN Platform only as necessary to enable your use of the EZ-CHECKIN Platform as a Guestt.
• Do not use the Content unless you have permission from the owner of the Content or the use is authorized by us in these Terms or another agreement you have with us.
• Do not use, copy, display, reflect or frame the EZ-CHECKIN Platform, Content, any EZ-CHECKIN mark or any layout or page layout without our consent.

Honor your legal obligations

• Understand and follow the laws that apply to you, including privacy, data protection and export laws.
• If you provide us with someone else’s personal information, you: (i) must do so in accordance with applicable law, (ii) you must be authorized to do so, and (iii) authorize us to process that information under our Privacy Policy.
• Read and follow our Terms, Policies and Standards.
• Do not organize or facilitate unauthorized parties or events. You are responsible for any parties or events during your booking that violate our rules for parties and events, as incorporated herein by reference.
• Do not use the name, logo, trademark or trademarks of EZ-CHECKIN or others without permission, as they are a registered trademark.
• Do not use or register any domain name, social media identifier, trade name, trademark, trademark, logo or other source identifier that may be confused with the EZ-CHECKIN brand, as we are a registered trademark.
• Does not offer or solicit prostitution or participate in or facilitate trafficking in persons.

7.2 Notification of Infringements If you believe that a Member, Listing or Content poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting EZ-CHECKIN. In addition, if you believe that a Member, List or Content has violated our Standards, you should report your concerns to EZ-CHECKIN. If you reported a problem to local authorities, EZ-CHECKIN may request a copy of that report. Except as required by law, you agree that we are not obligated to take action in response to any report.

7.3 Copyright Notices If you believe that the Content of the EZ-CHECKIN Platform infringes copyright, please notify us by means of a message to our email, specifying the violation that you believe is being committed, as well as the sufficient and necessary documents to prove it, and accordingly we can take action in this regard; if you fail to verify the violation or infringement, you agree that we will continue to use such content indefinitely.

8 Termination, suspension and other measures

8.1 Term The agreement between you and EZ-CHECKIN reflected in these Terms becomes effective when you access the EZ-CHECKIN Platform (for example, to create an account) and remains in effect until you or we terminate the agreement in accordance with these Terms.

8.2 Termination You may terminate this agreement at any time by sending us an email or deleting your account. EZ-CHECKIN may terminate this agreement and your account for any reason by notifying you 30 days in advance by email or using any other contact information you have provided for your account. EZ-CHECKIN may also terminate this agreement immediately and without notice and stop providing access to the EZ-CHECKIN Platform if you breach these Terms, violate our Policies, violate applicable laws, or reasonably believe that termination is necessary to protect EZ-CHECKIN, its Members, or third parties. If your account has been inactive for more than two years, we may terminate your account without notice, with any outstanding charges or defaults to us.

8.3 Member Violations If (i) you breach these Terms, our Policies or our Standards, (ii) you violate applicable laws, regulations or third party rights, or (iii) EZ-CHECKIN believes that it is reasonably necessary to protect EZ-CHECKIN, its Members or third parties; EZ-CHECKIN may, with or without notice:

• suspend or limit your access to or use of the EZ-CHECKIN Platform and/or your account;
• suspend or remove listings, reviews or other content;
• cancel pending or confirmed reservations; or
• suspend or revoke any special status associated with your account.

In the case of minor violations or where appropriate, as determined by EZ-CHECKIN in its sole discretion, EZ-CHECKIN will notify you of any intended action and you will have the opportunity to resolve the issue. You may appeal any actions we take under this Section by contacting customer service. If a reservation is canceled under this Section, the amount paid to the Host will be reduced by the amount we will refund or provide to the Guest, and by any other costs we incur as a result of the cancellation.

8.4 Legal Mandates EZ-CHECKIN may take any action it deems reasonably necessary to comply with applicable law, or the order or request of a court, police or other administrative agency or governmental body, including the measures described above in Section 8.3.

8.5 Survival Portions of these Terms that by their nature, will survive termination of this agreement, including Sections 2 through 17.

9 Modification EZ-CHECKIN may modify these Terms at any time. When we make material changes to these Terms, we will post the revised Terms on the EZ-CHECKIN Platform and update the “Last Updated” date at the top of these Terms. We will also notify you of any material changes by email at least 30 days before the date they become effective. If you do not agree to the revised Terms, you may terminate this agreement immediately as provided in these Terms. If you do not terminate your agreement prior to the date the revised Terms become effective, your continued access to or use of the EZ-CHECKIN Platform will constitute acceptance of the revised Terms.

10 EZ-CHECKIN Role We offer a platform that allows Members to search and book an Accommodation. While we work hard to ensure that our Members have excellent experiences with EZ-CHECKIN, we do not and cannot control the conduct of Guests. You acknowledge that EZ-CHECKIN has the right, but has no obligation, to monitor the use of the EZ-CHECKIN Platform and verify the information provided by our Members. For example, we may review, disable access to, remove or edit Content to: (i) operate, protect and improve the EZ-CHECKIN Platform (including for fraud prevention, risk assessment, research and customer support purposes); (ii) ensure Members’ compliance with these Terms; (iii) comply with applicable law or the order or requirement of a court, law enforcement, or other administrative agency or governmental body; (iv) address Content that we determine is harmful or objectionable; (v) take the steps set forth in these Terms; and (vi) maintain and enforce quality or eligibility criteria, including removing Ads that do not meet the quality and eligibility criteria. Members acknowledge and agree that EZ-CHECKIN administers its Policies (such as our Strenuous Circumstances Policy) and Standards (such as the basic requirements for hosts), including decisions on how to apply them in a particular situation, in its sole discretion. Members agree to cooperate and assist EZ-CHECKIN in good faith, and to provide EZ-CHECKIN with such information and to take such action as EZ-CHECKIN reasonably requests with respect to any investigation conducted by EZ-CHECKIN regarding the use or abuse of the EZ-CHECKIN Platform. EZ-CHECKIN does not act as an agent of any Member, except in cases where “EZ-CHECKIN Payments” acts as a collection agent as provided in the Payment Terms.

11 Member accounts You must register an account to access and use many features of the EZ-CHECKIN platform. Registration is only allowed for legal persons, companies and natural persons over 18 years of age. You represent and warrant that you are not a person or entity that is prohibited from using the EZ-CHECKIN Platform under local laws, your place of residence or any other applicable jurisdiction. You must provide accurate, current and complete information during registration and keep your account information up to date. You may not register more than one account or transfer your account to another person. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to third parties. You are responsible for the activities performed through your account and must immediately notify EZ-CHECKIN if you suspect that your credentials have been lost, stolen or that your account is compromised. If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) perform checks designed to help verify your identity or background, (iii) evaluate you against third party databases or other sources, and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or records of sex offenders or their local equivalents.

12 Disclaimer of Warranties We provide the EZ-CHECKIN Platform and all Content “as is” without warranty of any kind and disclaim all warranties, whether express or implied. For example: (i) we do not endorse or warrant the existence, conduct, performance, safety, quality, legality or suitability of any Guest, Listing or third party; (ii) we do not guarantee the performance or non-interruption of the EZ-CHECKIN Platform; and (iii) we do not warrant that the verification, identity, or background checks conducted on listings or members (if any) will identify past misconduct or prevent future misconduct. Any reference to a Member or Listing being “verified” (or similar language) indicates only that the Member or Listing or EZ-CHECKIN has completed a relevant verification or identification process and nothing else. The disclaimers in these Terms apply to the fullest extent permitted by law. If you have legal rights or warranties that we cannot deny, the duration of such rights or warranties required by law shall be limited to the fullest extent permitted by law.

13 Limitations of Liability Neither EZ-CHECKIN (including its affiliates and staff) nor any other party involved in the creation, production or delivery of the EZ-CHECKIN Platform or any Content shall be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss. goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use or inability to use the EZ-CHECKIN Platform or any Content, (iii) any communication, interaction or meeting you may have with someone with whom you interact or meet through, or as a result of, your use of the EZ-CHECKIN Platform, or (iv) Post or book, whether by warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not EZ-CHECKIN has been advised of the possibility of such damages, even if it is determined that a limited remedy set forth in these Terms has not served its essential purpose.

These limitations of liability and damages are fundamental elements of the agreement between you and EZ-CHECKIN. If applicable law does not allow the limitations of liability set forth in these Terms, the above limitations may not apply to you.

14 Applicable law and jurisdiction If you reside or have your place of establishment in Mexico, these Terms shall be construed in accordance with the laws of Mexico, and primarily the State of Baja California, without regard to conflict of law provisions. Court proceedings (other than small claims actions) that are excluded from the out-of-court settlement must be initiated in a state or federal court where applicable, in the city of Playas de Rosarito, Baja California, Mexico, excluding any other by reason of your present or future domicile. Both you and we accept personal place and jurisdiction in Playas de Rosarito, Baja California.

15 Extrajudicial Settlement of conflicts and disputes

15.1 Application This Out-of-Court Settlement applies to you regardless of your country of residence. If your country of residence or establishment is not Mexico and, nevertheless, you try to file a legal claim against EZ-CHECKIN in another country, this will have no effect, since you expressly waive to file any lawsuit or request for agreement in another country or state of the Mexican Republic, since it aceota that they are the State or Federal courts of Playas de Rosarito, Baja California, Mexico, who settle the dispute in case of failure to establish an out-of-court agreement between the parties.

15.2 Overview of the Dispute Resolution Process EZ-CHECKIN is committed to participating in a consumer-friendly dispute resolution process. To that end, these Terms establish a two-part process for persons to whom this Section 15 applies: (1) an informal negotiation directly with EZ-CHECKIN’s customer service team (described in paragraph 23.3 below), and if necessary (2) to go to previously agreed court. Both you and EZ-CHECKIN retain the right to seek redress in court.

15.3 Notice and Resolution of Out-of-Court Disputes At least 30 days before initiating a trial before court, you and EZ-CHECKIN agree to notify the other party in writing of the dispute by email previously indicated by both parties on your general or EZ-CHECKIN platform and to attempt in good faith to negotiate an out-of-court resolution. You must send your dispute notice to EZ-CHECKIN by mailing it to the EZ-CHECKIN agent for service:

EZ-CHECKIN will send your dispute notice to the email address associated with your EZ-CHECKIN Account. A notice of dispute should include: the name of the party and preferred contact information, a brief description of the dispute, and the relief sought. If the parties are unable to resolve the dispute within the 30-day period, only then can either party commingle a trial before the judicial courts of Playas de Rosarito, Baja California, Mexico.

15.4 Out-of-Court Resolution Agreement You and EZ-CHECKIN mutually agree that any dispute, claim or controversy arising out of or relating to these Terms or the enforceability, breach, termination, validity, enforceability or interpretation thereof, or any use of the EZ-CHECKIN Platform, Accommodations or any Content (collectively, the “Disputes”) will first be resolved by out-of-court settlements, and where applicable by a court of the city of Beaches of Rosarito, Baja California, Mexico. If there is a dispute as to whether this Out-of-Court Agreement can be enforced or applies to our Dispute, you and EZ-CHECKIN agree that you may go before the judge of the judicial court of Playas de Rosarito, Baja California, Mexico, who will decide that matter.

15.5 Exceptions to the Out-of-Court Settlement Both you and EZ-CHECKIN agree that the following causes of action and/or claims for redress are exceptions but not limited to the Out-of-Court Settlement and may be brought in court proceedings in a court of competent jurisdiction (as defined in Section 14): (i) any claim or cause of action alleging infringement, misappropriation or actual infringement or threat of a party’s copyright, trademark, trade secret, patent or other intellectual property rights; (ii) any claim or cause of action seeking an emergency injunction based on compelling circumstances (e.g., imminent danger or commission of a crime, hacking, cyber attack); or (iii) a request for redress of public injunctive relief.

15.6 Absence of class actions or representative proceedings You and EZ-CHECKIN acknowledge and agree that, to the fullest extent permitted by law, each of us waives the right to participate as a plaintiff or class member in any alleged class action trial, class arbitration, private attorney general action, or any other. representative or consolidated procedure. Unless we agree in writing, therefore the claims of more than one of the parties cannot be consolidated and may not generate any type of collective or representative procedure. If there is a final judicial determination that applicable law precludes the enforcement of the waiver contained in this paragraph as to any claim, cause of action, or remedy sought, then that claim, cause of action, or remedy requested, and only that claim, cause of action, or remedy requested, shall be set aside from this agreement and shall be brought in a court of competent jurisdiction. In the event that a claim, cause of action, or remedy requested is discontinued pursuant to this paragraph, then you and we agree that the claims, causes of action, or remedies requested that are not subject to a trial will be suspended until all claims within the trial, causes of action, and requested remedies are resolved by the judge.

15.7 Severability In the event that any part of the out-of-court settlement is deemed illegal or unenforceable, such provision shall be eliminated and the remainder of the out-of-court settlement shall have full force and effect.

15.8 Changes to the Out-of-Court Settlement If EZ-CHECKIN changes this Section 15 after the date you last accepted these Terms (or accepted any subsequent changes to these Terms), you may reject that change by sending us written notice (including by email) within 30 days of the date the change is effective. However, rejecting a new change does not revoke or alter your prior consent to any prior agreement to settle any Dispute between you and EZ-CHECKIN (or your prior consent to any subsequent changes thereto), which will remain in effect and enforceable with any Dispute. between you and EZ-CHECKIN.

15.9 Survival This Section 15 will survive the termination of these Terms and will continue to apply even if you stop using the EZ-CHECKIN Platform or cancel your EZ-CHECKIN account.

16 Resolution of disputes from the rest of the world, venue and forum and applicable law If you reside or have your place of establishment outside of Mexico, this Section applies to you and these Terms shall be construed in accordance with Mexican laws. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded. The choice of law does not affect your rights as a consumer. If you are acting as a consumer, you agree to submit to the exclusive jurisdiction of the courts of Playas de Rosarito, Baja California, Mexico. Legal proceedings you may bring against us arising out of or relating to these Terms may only be commenced in a court located in Playas de Rosarito, Baja California, Mexico. If EZ-CHECKIN wishes to assert any of its rights against you as a consumer, we may do so in the courts of Playas de Rosarito, Baja California, Mexico or the jurisdiction in which you reside. If you are acting as a company, you agree to submit to the exclusive jurisdiction of the courts of Playas de Rosarito, Baja California, Mexico.

17 Miscellaneous

17.1 Other Terms Incorporated by Reference Our Host Warranty Terms, Guest Refund Policy, Experience Guest Refund Policy, Content Policy, Non-Discrimination Policy, Strenuous Circumstances Policy, Policies, Standards and other supplemental policies and terms linked in these Terms apply to your use of the EZ-CHECKIN platform, are incorporated by reference and form part of your agreement with EZ-CHECKIN.

17.2 Interpretation of these Terms Except as may be supplemented by additional terms, conditions, policies, guidelines, standards and product disclosures, these Terms (including items incorporated by reference) constitute the entire agreement between EZ-CHECKIN and you in connection with your access to or use of the EZ-CHECKIN Platform and supersede any and all prior oral or written agreements or agreements between EZ-CHECKIN and you. These Terms do not confer or intend to confer any rights or remedies on anyone other than you and EZ-CHECKIN. If any provision of these Terms is held to be invalid or unenforceable, except as otherwise provided in these same terms, such provision shall be eliminated and shall not affect the validity and enforceability of the remaining provisions. When the word “will” is used in these Terms, it connotes an obligation with the same meaning as “shall.”

17.3 No Waiver EZ-CHECKIN’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing by us. Except as expressly set out in these Terms, the exercise by either party of any of its remedies under these Terms shall be without prejudice to its other remedies under these Terms or permitted by law.

17.4 Assignment You may not assign, transfer or delegate this agreement or your rights and obligations below without the prior written consent of EZ-CHECKIN. EZ-CHECKIN may, without limitation, assign, transfer or delegate this agreement and any rights and obligations thereunder, in its sole discretion.

17.5 Notice Unless otherwise specified, notices or other communications to Members permitted or required under this agreement will be provided electronically and will be sent by EZ-CHECKIN by email by the EZ-CHECKIN platform notification, messaging service (including SMS and WeChat) or any other contact method we enable and you provide.

17.6 Third Party Services The EZ-CHECKIN Platform may contain links to third-party websites, applications, services or resources (“Third Party Services”) that are subject to different privacy terms and practices. EZ-CHECKIN is not responsible for any aspect of such Third Party Services and links to such Third Party Services are not an endorsement.

17.7 Google Terms Some translations of the EZ-CHECKIN platform are supported by Google. Google and EZ-CHECKIN disclaim all warranties relating to translations, express or implied, including warranties of accuracy, reliability, and any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some areas of the EZ-CHECKIN platform implement Google Maps/Earth map services, including Google Maps APIs. Use of Google Maps/Earth is subject to the Google Maps/Google Earth Additional Terms of Service.

17.8 Content of the EZ-CHECKIN platform The content available through the EZ-CHECKIN platform may be protected by copyrights, trademarks and/or other laws of Mexico and other countries. You acknowledge that all intellectual property rights in that Content are the exclusive property of EZ-CHECKIN and/or its licensors and agree that you will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices. You may not use, copy, adapt, modify, prepare derivative works from, distribute, license, sell, transfer, publicly display, publicly perform, transmit, disseminate or otherwise exploit any Content accessed through the EZ-CHECKIN Platform, except to the extent that you are the legal owner of that Content or as expressly permitted in these Terms. Subject to your compliance with these Terms, EZ-CHECKIN grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to (i) download and use the Application on your personal devices; and (ii) access and view the Content available on the EZ-CHECKIN Platform and accessible to you, solely for your personal, non-commercial use.

17.9 EZ-Checkin.com EZ-CHECKIN is a for-profit company and is not exempt from compliance in the payment of taxes that correspond to it in accordance with its activities and in accordance with the Mexican laws of the matter.

17.10 Force majeure EZ-CHECKIN shall not be liable for any delay or non-compliance resulting from causes beyond its reasonable control, including, but not limitation, cases of force majeure, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fires. , floods, accidents, pandemics, epidemics or diseases, strikes or shortages of means of transport, fuel, energy, labor or materials.

17.11 Emails and SMS You will receive our administrative communications using the email address or other contact information you provide for your EZ-CHECKIN account. Enrolling in additional email subscription programs will not affect the frequency of these administrative emails, although you should expect to receive additional emails specific to the programs to which you have subscribed. You may also receive promotional emails from us. No fees are charged for these promotional emails, but third-party data fees may apply. You can control whether you receive promotional emails using the notification preferences in your account settings. Please note that you will not be able to take advantage of certain promotions if you disable certain communication settings or do not have an EZ-CHECKIN account. In Mexico and all other countries, if you agree to receive SMS (text messages) from us, you will be subject to our SMS Terms.
